TERMS OF SALE OF THE ONLINE STORE

The owner of the online store www.fend.ee (hereinafter the Online Store) is Fend OÜ (registry code 17170048), located at Tartu mnt 51b, Kohtla-Järve, Ida-Virumaa, Republic of Estonia.

Validity of the Sales Contract, Product, and Price Information The terms of sale apply to the purchase of goods from the Online Store. The prices of the products sold in the Online Store are indicated next to the products. A fee for the delivery of the goods is added to the price. All prices of goods sold in the Online Store are in euros. The delivery fee depends on the buyer's location and the delivery method. The delivery fee is displayed to the buyer upon completing the order. Information about the goods is provided in the Online Store directly next to the goods.

Placing an Order To order goods, the desired products must be added to the shopping cart. To complete the order, the required data fields must be filled in, and a suitable delivery method must be selected. The total amount is then displayed on the screen, which can be paid securely via the following payment methods:

  • Estonian bank links

  • Finnish bank links

  • Latvian bank links

  • Lithuanian bank links

  • Visa/Mastercard card payments

NB! When paying via a bank link, be sure to click the "Return to merchant" button on the bank's page. Payments are mediated by Maksekeskus AS. Payment takes place outside the Online Store in a secure environment – in the secure environment of the respective bank when paying via a bank link, and in the secure environment of Maksekeskus AS when paying by credit card. The seller does not have access to the customer's bank and credit card details. The contract enters into force upon receipt of the amount due into the Online Store's bank account. The owner of the Online Store is the controller of personal data and forwards the personal data necessary for making payments to the authorized processor Maksekeskus AS. If the ordered goods cannot be delivered due to being out of stock or for any other reason, the buyer will be informed of this as soon as possible, and the paid money (including delivery costs) will be refunded promptly, but no later than within 14 days of sending the notice.

Delivery Goods are shipped to the following countries: European Union countries. To receive the goods, the buyer has the following options: the Online Store's parcel machine partners, courier companies. The buyer bears the shipping costs, and the respective price information is displayed next to the shipping method. Domestic shipments within Estonia generally reach the destination specified by the buyer within 4 working days from the entry into force of the sales contract. Delivery outside of Estonia takes place within 45 calendar days. In exceptional cases, there is the right to deliver the goods within up to 45 calendar days.

Right of Withdrawal After receiving the order, the buyer has the right to withdraw from the contract entered into in the e-shop within 14 days. The right of withdrawal does not apply if the buyer is a legal entity. To exercise the 14-day right of return, the ordered goods must not be used in any other way than is necessary to ascertain the nature, characteristics, and functioning of the goods in the same manner as allowed for testing the goods in a physical store. If the goods have been used for purposes other than what is necessary to ascertain the nature, characteristics, and functioning of the goods, or if they bear signs of use or wear, the Online Store has the right to lower the refundable fee in accordance with the decrease in the value of the goods. To return the goods, a declaration of withdrawal from the purchase of goods must be submitted and sent to the e-mail address fendouinfo@gmail.com no later than 14 days from receiving the goods. The buyer bears the costs of returning the goods, unless the reason for the return is that the product to be returned does not correspond to the order (e.g., an incorrect or defective product). The buyer must return the goods within 14 days following the submission of the declaration or provide proof that they have handed over the goods to a carrier within the aforementioned period. Upon receiving the returned goods, the Online Store shall refund the buyer promptly, but no later than 14 days after receiving the declaration of withdrawal, all payments received from the buyer under the contract. The Online Store may refuse to issue refunds until it has received the item that is the subject of the contract back or until the buyer has provided proof of having sent back the item, whichever happens first. If the buyer has explicitly chosen a delivery method different from the cheapest standard delivery method offered by the Online Store, the Online Store is not required to refund to the consumer the cost that exceeds the cost associated with the standard delivery method. The Online Store has the right to withdraw from the sales transaction and demand the return of the goods from the buyer if the price of the goods in the online store has been marked significantly below the market price due to an error.

Right to File a Complaint The Online Store is responsible for the non-conformity of goods sold to a buyer with the terms and conditions of the contract or for shortcomings which existed at the time of delivery and which occur within two years of delivering the goods to the buyer. Within the first 1 year from the delivery of the goods to the buyer, it is presumed that the defect existed at the time of delivery. Rebutting this presumption is the responsibility of the Online Store. In the event of a defect, the buyer has the right to contact the Online Store within two months by sending an e-mail to fendouinfo@gmail.com. The Online Store is not liable for defects that have arisen after the delivery of the goods to the buyer. If goods purchased from the Online Store have defects for which the Online Store is responsible, the Online Store will repair or replace the defective goods. If the goods cannot be repaired or replaced, the Online Store will return to the buyer all fees associated with the sales contract. The Online Store responds to the consumer's complaint in written form or in a format that can be reproduced in writing within 15 days.

Direct Marketing and Processing of Personal Data The Online Store uses the personal data entered by the buyer only for processing the order and sending the goods to the buyer. The Online Store forwards personal data to transport service companies in order to deliver the goods. The Online Store sends newsletters and offers to the buyer's e-mail address only if the buyer has expressed a wish for this by entering their e-mail address on the website and indicating their desire to receive direct mail. The buyer can opt out of offers and newsletters sent to their e-mail at any time by notifying us via e-mail or by following the instructions provided in an e-mail containing an offer.

Settlement of Disputes If the buyer has complaints regarding the Online Store, they must be sent to the e-mail address fendouinfo@gmail.com. If the buyer and the Online Store are unable to resolve the dispute by agreement, the buyer may contact the Consumer Disputes Committee. The procedural conditions can be viewed and the application submitted here. The Consumer Disputes Committee is competent to resolve disputes arising from the contract concluded between the buyer and the Online Store. The review of the buyer's complaint by the committee is free of charge. The buyer may turn to the European Union's online dispute resolution platform.
